Under Communications Act of 1934, Broadcast of Pro-Israeli Pro-Jewish Misinformation across America is Illegal
Atlanta, GA, October 11, 2023 … Today, the Federal Communications Commission (FCC) was issued an in-depth Legal Notice on behalf of the Anti-Semitism Defense League (ADL) concerning anti-Semitic disinformation being disseminated by FCC-regulated mediums. The “Prohibited Content” is found on social media platforms, internet-based news outlets, television broadcasts, radio communication networks, private websites via Internet Service Providers (ISPs), and beyond. Prompted by the recent proliferation of hate speech, slander, and calls for violence against innocent Semitic Palestinian civilians inhabiting the Gaza Strip, ADL condemns Judaic Propaganda that violates Federal law, and urges U.S. persons and entities to denounce anti-Semitic disinformation everywhere it may occur.
Palestinian nationalist group Hamas recently launched a counteroffensive on the Jewish State in response to the on-going ethnic cleansing that has been taking place since 1948. “There is so much ‘silent harm’ and psychological trauma, that may not be immediately apparent, resulting from the erosion of economic, social and cultural rights. These debilitating processes have severe short and long-term consequences and must be urgently addressed,” warned United Nations (U.N.) Commissioner Miloon Kothari. Israeli occupation of Palestine has been declared unlawful under international law by the U.N., but the Jewish State has consistently refused to comply with the rule of law.

The Jewish people falsely claim to be the rightful owners of the ancient Land of Israel, which includes Gaza. “Israel’s founding father David Ben-Gurion proclaimed the modern State of Israel on May 14, 1948, establishing a safe-haven for Jews fleeing persecution and seeking a national home on land to which they cite deep ties over generations,” according to Reuters. Disinformation is contrary to “public interest, convenience, and necessity,” making FCC sanctioning of such “Prohibited Content” unconstitutional, under Article 1, Section 8 of the United States Constitution.
According to the U.S. Supreme Court, “In granting or withholding permits for the construction of stations, and in granting, denying, modifying or revoking licenses for the operation of stations, ‘public convenience, interest, or necessity’ was the touchstone for the exercise of the [Federal Communication] Commission’s authority.”
Using pro-Jewish, pro-Israeli, anti-Semitic hate speech, slander, and calls to violence against Palestinian Semites, Judaic Propaganda garnered public support to move America’s USS Gerald R. Ford Carrier Strike Group toward Israel. “They will hit Gaza, and take steps for serious massacres there,” said Turkiye’s President Recep Tayyip Erdogan. Discriminatory, biased disinformation that serves the personal interests of a particular group is in violation of the Communications Act of 1934, and is grounds for revocation of FCC license. In addition, FCC-regulated mediums that disseminate “Prohibited Content” are subject to carrier liability for damages.
